Justin Timberlake’s driver’s license was suspended on Friday during a hearing for his DWI case on Long Island, New York.
43-year-old Timberlake pleaded not guilty to a revised DWI charge during the 9:30 a.m. hearing in Sag Harbor Village Justice Court, Deadline reported.
Justice Carl Irace made the motion to suspend the entertainer’s license in New York due to the fact that he refused to take a breathalyzer test when he was pulled over near the American Hotel on June 18th.
The former NSYNC singer, who is on tour in Europe, wasn’t required by the court to return to the U.S. for his court date. He is set to perform in Antwerp, Belgium on Saturday.
However, his attorney, Edward Burke Jr., has maintained that Timberlake was not drunk and that the case should be dropped.
“The facts remain he was not intoxicated,” Burke said Friday, according to Newsday. “I’ll say it again: Justin Timberlake was not intoxicated and we’re very confident that charge, that criminal charge, will be dismissed.”
Meanwhile, the next conference in the case was set for August 9th. Timberlake will not be required to attend.
The “Cry Me a River” singer may have to appear at a hearing scheduled for September 13th. By that time will be back in the U.S. following his European appearances of his The Forget Tomorrow World Tour.
During the time of the arrest, Timberlake claimed that he had just “one martini” after he drove through a stop sign after a night out with friends.
Timberlake’s attorney moved to dismiss the charges against his client claiming that the initial charges documents are invalid because they were not signed by a superior officer.
“The DA is trying to fix something here — you’re going to scratch your head and ask yourself why this wasn’t [resolved] immediately? There’s not a spot of ink that has the sergeant’s signature,” Burke told reporters after last week’s proceedings.
Burke removed the motion to dismiss the case during Friday’s hearing.
